When signed below, this document will become a binding agreement between MJTR Contractors, Ltd., DBA- J National l (herein,” J National) or (“Contractor”), and the party named below, whether Owner or Manager (herein, “Owner”), for services rendered o the property address below and for the consideration described in this agreement.
Scope of work: Contractor is hereby authorized to perform the work described above, and therefore this contract is void without a signature.

Date of Commencement of work: Service Contractor will contact you with date & time of service. Emergency plumbing and electrical service requests will be given priority. Extensions of Time: Date of completion will be extended in the event of weather delays, failure of owner to pay payments timely, delays in delivery of materials and change orders.Payments: Invoices shall be paid within 7 days after completion of the job.
Obligations of Contractor: 1. Work shall be completed in a workman-like manner & in compliance with all building codes and other applicable laws. 2. To the extent required by code or law, all work should be performed by individuals duly licensed and authorized by law to perform the work. 3. Contractor may engage subcontractor to perform work hereunder, provided contractor shall fully pay any sub-contractor, and continue and continue to be responsible for the performance and quality of the work. 4. Contractor will supply owner with appropriate lien releases upon payment. 5. Contractor agrees to use every reasonable source to acquire materials that are available from the usual sources. 6. Contractor and owner agree that no mold, asbestos or other hazardous materials are included in this agreement, and owner is responsible for hiring a remediation contractor in the event hazardous materials are discovered during the work.

Warranty of workmanship: Contractor warranties extend to defective workmanship or defective materials during the following warranty periods:

1. Roof Leaks: Up to 1 year, excludes any interior/hidden damage (same location).
2. Hydro-jet/Backups: 24 Hours.
3. Plumbing Repairs: 90 Days parts/ 30 Days labor.
4. Electrical Repairs: 90 days parts/ 30 days’ labor.
5. Steps & Welding: 90 days labor only.
6. After Hours Charges: Start after 4:00 p.m..

***NOTE: Warranties are limited to those expressly made in this contract, and no other warranties are made, either expressed or implied. ***
Plumbing Service for Underground Water Leaks: J National is not responsible for shutting off water nor for turning water back on. A property maintenance man or manager must be on hand to do these operations. J National is not responsible for replacing shrubs, sod, or any landscaping in the course of excavating. Owner will replace these items at owner’s expense. Any unforeseen damages or circumstances will be addressed with a “Change Order” for the additional work & costs required to complete the job. Representation of Owner/Manager: The party signing this agreement does by his/her signature below represent that he/she has authority to legally bind the entity that owns the property, is properly authorized by the owner/manager to execute this contract, and has authority to obligate the owner/manager to execute this contract, and has authority to obligate the owner/manager to the contract price and payments, and further represents that the Owner’s name is properly set forth in this contract. Remedy of Owner/ Manager: The parties agree that owner’s remedies are limited to the repair/replacement of the warranted work by Contractor. Contractor shall not be liable for consequential damages or losses. All warranties are subject to cancelation for owner’s failure to pay. Contractor shall not be required to subrogate it’s work to any mortgage holder. Insurance & Identification: Contractor agrees to maintain insurance solely in connection with the work in addition to any owner’s work, in addition to any owner’s insurance and only during the entire term of the work. Owner agrees to rely on owner’s insurance for any non-warranty claims, damages, losses and expenses occurring during contractor’s performance of the work, including attorney fees. Owner agrees that if Owner determines that contractor has failed to perform the work as agreed, then owner shall notify contractor immediately by email or telephone of any problem concerning contractor’s performance of the work. Attorney Fees: Owner agrees that in the event owner does not pay as agreed in this agreement, owner shall pay to contractor all attorney fees and court costs required to obtain payment for all amounts due under terms of this agreement. Term of Offer: This form may be an offer of contractor or a contract. In the event that this document is signed by a representative of contractor, but not the owner or Manager representing the owner, then it will be merely an offer to contract. If this document is not signed ad returned to Contractor by owner or manager within 30 days, then this offer will be void. After Hours Charges: In the event the work must be completed in a short period of time, the parties agree that that after hour charges will apply, and will agree on a premium price to allow for the overtime or other expenses be required to accomplish the work in a short period of time.Excluded Work: J National is not responsible for shutting off water nor turning water back on. A property maintenance man or manager must be available to do these operations. J National is not responsible for replacing any shrubs, sod, or any landscaping in the course of excavating. Owner will replace these items at owner’s expense. In the event that the work exposes terrible damage, water damage, or other hidden matters that cause the expense of the work to increase, the owner agrees to increase the contract price to compensate for such hidden damage. The work is limited to the work described in this contract, and does not include any other work  Non-Compete: Owner and its manager agree not to contract or employ, directly or indirectly and of the contractor employees or subcontractors for the period of one (1) year from the completion of any work under this contract.Entire and Binding Agreement: This contract, including attachments indicated, contains all the agreements of the parties and may be modified only by writing and signed by both the owner and contractor.
